Proof of Unlawful Maintenance Payments

Around 200,000 marriages are dissolved in Germany each year. Hamburg is no exception, although it ranks among the lower end in the statistics. Compared nationwide, people in northern Germany are considered rather loyal: while an average of 11 per cent of marriages end in divorce each year, in Hamburg and the surrounding area it is only around 2 per cent of the population. Every separation also raises the question of who must pay maintenance to whom, and in what amount.

Regardless of whether you are obliged to pay maintenance or entitled to receive it, agreement with an ex-partner is rare. Often one party benefits, while the other faces difficulties. A new cohabiting relationship is sometimes deliberately kept out of the public eye, as entitlement to spousal maintenance generally no longer applies in such cases. The party liable to pay maintenance may conceal their true income, or the recipient may have a reduced entitlement because they do not fully disclose their earnings – in all such cases, the private investigators of Kurtz Investigations Hamburg are the right contact for you: +49 40 2320 5053.

Concealed Income of the Maintenance Recipient

Time and again, those receiving maintenance from a divorced partner attempt to hide increases in income in order to avoid reductions in their payments. To prevent detection, many recipients of post-marital maintenance take on (secondary) employment that is not reported to social security authorities (undeclared work). As a result, such activities cannot be uncovered through official channels.

Instead, the private investigators of Kurtz Detective Agency Hamburg can assist you by conducting surveillance of the maintenance recipient. Whether your ex-wife secretly works as a cleaner or your ex-husband carries out skilled labour in private households after working hours – our Hamburg private detectives will find out: kontakt@kurtz-detektei-hamburg.de.

Undeclared work as a form of concealed income occurs among both maintenance recipients and payers in order to circumvent maintenance law and deliberately deprive the ex-partner of money.

Concealed New Cohabiting Relationship

Some time after separation – or sometimes even during the marriage – both partners usually enter into new relationships. This in itself is, of course, not objectionable. However, if the former spouse moves in with a new partner or otherwise shares financial responsibilities and daily life, the amount of maintenance payments changes, and in some cases the entitlement ceases altogether. For example, if your divorced wife moves in with her new partner, her entitlement to maintenance may be reduced or eliminated entirely.

For this reason, such cohabiting relationships are often concealed. In straightforward cases, where your ex-wife openly shares a home with her new partner but does not inform you, proof can be obtained relatively easily. However, if the couple deliberately keeps the relationship secret, long-term surveillance may be required. Despite effectively living together, they may maintain separate residences, use back or basement entrances to access each other’s homes, avoid being seen together in public, or park their vehicle far away from the other’s residence.

Even in complex situations of this kind, we are your competent investigators in Hamburg. Kurtz Investigations Hamburg will find out whether your ex-partner is unlawfully depriving you of money, provided you grant us the necessary freedom to conduct our investigations: +49 40 2320 5053.
